Thank you for purchasing our products! We make them to serve the many fans of kpop out there! There are tons of supporters browsing the love club each and every day. Because we don’t know every one of our supporters personally (although we wish we did), we have to put in place some Terms of Service to help keep the club going.

YOUR ACCESS TO OR USE OF ANY THE SERVICES SIGNIFIES THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THE TERMS. By accessing or using any Services you also represent that you have the legal authority to accept the Terms on behalf of yourself and any party you represent in connection with your use of any Services. If you do not agree to the Terms, you are not authorized to use any Services.

General

When we say “Company”, “we”, “our”, or “us” in this document, we are referring to OnceLoveClub LLC. 

When we say “Services”, we mean our website oncelove.club, and any product created and maintained by OnceLoveClub LLC. That includes our stickers, rugs, apparel, accessories but not limited to and any another format.

When we say “You” or “your” or "supporters", we are referring to the people or organizations that purchases or maintains a relationship with one or more of our Services. 

Errors and Inaccuracies

From time to time, OnceLoveClub LLC may change, remove, or add to the Terms, and reserves the right to do so in its discretion. In that case, we will post updated Terms and indicate the date of revision. If we feel the modifications are material, we will make reasonable efforts to post a prominent notice on the relevant Website(s) and notify those of you with a current subscription account via email. All new and/or revised Terms take effect immediately and apply to your use of the Services from that date on. Your continued use of any Services after new and/or revised Terms are effective indicates that you have read, understood, and agreed to those Terms.

Secure Processing

Oncelove.club utilizes industry standard SSL Encryption Technology for all payment processing. We are dedicated to preventing and detecting fraud and all online orders are rigorously checked to ensure a legitimate transaction. Your payment will always be secure.

Cancellation Policy

We do not allow cancellations for any reasons on every and all purchases. All orders are deemed final and can not be changed.

Return Policy

We do not allow returns for any reasons on every and all purchases. All orders are deemed final and can not be returned.

Shipping and Taxes

All orders purchased through our Site are fulfilled and shipped via but not limited to UPS, FEDEX, or USPS. Our carrier choice is selected to be the most efficient to deliver to our supporters. All international orders outside of the United States of America are responsible for customs duties and/or brokerage fees alongside the shipment costs we charge at checkout. Supporters which reside within California will be charged sales tax set by the governing State of California and/or the County you reside in. Aside from California the applicable sales tax will pertain to your order if necessary as outlined by the laws outlining tax in your domain.

OnceLoveClub LLC is not held responsible for any lost or damaged packages. Submitting a chargeback with your payment provider will result in a permanent ban from all services provided by us.

User Content and Other Submissions

Your responsibility: You represent, warrant, and agree that no Content posted or otherwise shared by you on or through any of the Services (“Your Content”), violates or infringes upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, breaches or conflicts with any obligation, such as a confidentiality obligation, or contains libelous, defamatory, or otherwise unlawful material.

Your Content: Submissions of Your Content to OnceLoveClub LLC via any form of communication shall remain sole property belonging to Us. We shall own all exclusive rights, titles, and interests and not limited in its usage. We are not held under any obligation to maintain Your Content, pay You or any one person or entity compensation for Your Content, or respond to any of Your Content.

Community and Communication

By utilizing any of the Services, you represent and warrant that you (1) are the age of majority in your jurisdiction (typically age 18) or, (2) are over the age of 13 and have the express permission of a legal guardian to obtain an account and to use Services in connection with OnceLoveClub LLC. Services offered to users are provided subject to these Master Terms and any Additional Terms specified on the relevant Website(s).

You also agree that we can send you electronic mail or other communications of our services or products as OnceLoveClub LLC deems appropriate. Please refer to our Privacy Policy.

Termination: OnceLoveClub LLC reserves the right to modify or discontinue your access  at any time for any reason or no reason at all.

Colors

We have made efforts to display accurately the colors of products that appear at the Site. However, as the actual colors you see will depend on your monitor and/or other technological circumstance, we cannot and do not guarantee that your monitor's display of any color will be accurate. All products are represented as accurate as possible, OnceLoveClub LLC is not held responsible for any inaccuracies that may present upon Your reception of our package.

Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ONCELOVECLUB LLC OFFERS THE SERVICES (INCLUDING ALL CONTENT AVAILABLE ON OR THROUGH THE SERVICES) AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE SERVICES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ONCELOVECLUB LLC DOES NOT WARRANT THAT THE FUNCTIONS OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CONTENT MADE AVAILABLE ON OR THROUGH THE SERVICES WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY SERVERS USED BY ONCELOVECLUB ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ONCELOVECLUB LLC DOES NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING USE OF THE CONTENT AVAILABLE THROUGH THE SERVICES IN TERMS OF ACCURACY, RELIABILITY, OR OTHERWISE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ONCELOVECLUB LLC BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE OR INCOME, LOST PROFITS, PAIN AND SUFFERING, EMOTIONAL DISTRESS, COST OF SUBSTITUTE GOODS OR SERVICES, OR SIMILAR DAMAGES SUFFERED OR INCURRED BY YOU OR ANY THIRD PARTY THAT ARISE IN CONNECTION WITH THE SERVICES (OR THE TERMINATION THEREOF FOR ANY REASON), EVEN IF ONCELOVECLUB LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ONCELOVECLUB LLC IS NOT RESPONSIBLE OR LIABLE WHATSOEVER IN ANY MANNER FOR ANY CONTENT POSTED ON OR AVAILABLE THROUGH THE SERVICES (INCLUDING CLAIMS OF INFRINGEMENT RELATING TO THAT CONTENT), FOR YOUR USE OF THE SERVICES, OR FOR THE CONDUCT OF THIRD PARTIES ON OR THROUGH THE SERVICES.

Certain jurisdictions do not permit the exclusion of certain warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. IN THESE JURISDICTIONS, THE FOREGOING EXCLUSIONS AND LIMITATIONS WILL BE ENFORCED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

Indemnification

To the extent authorized by law, you agree to indemnify and hold harmless OnceLoveClub LLC, its employees, officers, directors, affiliates, and agents from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys fees, resulting directly or indirectly from or arising out of (a) your violation of the Terms, (b) your use of any of the Services, and/or (c) the Content you make available on any of the Services.

Privacy Policy

OnceLoveClub LLC is committed to responsibly handling the information and data we collect through our Services in compliance with our Privacy Policy, which is incorporated by reference into these Master Terms. Please review the Privacy Policy so you are aware of how we collect and use your personal information.

Trademark Policy

Names, logos, icons, and other trademarks may not be used without written permission provided by OnceLoveClub LLC and specifically should not be used in connection with any other product or service, or in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us.

Copyright Policy

The Site, and all information, text, graphics, images, illustrations, logos, designs, icons, photographs, video clips, and written or other materials software and all HTML, CGI and other codes and scripts in any format used to implement, or featured on, the Site (‘Content’) are the property of OnceLoveClub.

All Content on the Site is protected by United States copyright, trademark and other laws and applicable international treaties and conventions governing intellectual property law. Any and all trademarks, logos, page headers, custom graphics, button bars, service marks and trade names which OnceLoveClub LLC uses in connection with the Site shall remain Our exclusive property.

Any rights not expressly granted herein are reserved.

Termination

By OnceLoveClub LLC: OnceLoveClub LLC may modify, suspend, or terminate the operation of, or access to, all or any portion of the Services at any time for any reason. Additionally, your individual access to, and use of, the Services may be terminated by OnceLoveClub LLC at any time and for any reason.

By you: If you wish to terminate this agreement, you may immediately stop accessing or using the Services at any time.

Automatic upon breach: Your right to access and use the Services terminates automatically upon your breach of any of the Terms. 

Survival: The disclaimer of warranties, the limitation of liability, and the jurisdiction and applicable law provisions will survive any termination. Your warranties and indemnification obligations will survive for one year after termination.

Miscellaneous Terms

Choice of law: The Terms are governed by and construed by the laws of the State of California in the United States, not including its choice of law rules.

Dispute resolution: The parties agree that any disputes between OnceLoveClub LLC and you concerning these Terms, and/or any of the Services may only brought in a federal or state court of competent jurisdiction sitting in the Southern District of California, and you hereby consent to the personal jurisdiction and venue of such court.

If you are an authorized agent of a government or intergovernmental entity using the Services in your official capacity, including an authorized agent of the federal, state, or local government in the United States, and you are legally restricted from accepting the controlling law, jurisdiction, or venue clauses above, then those clauses do not apply to you. For any such U.S. federal government entities, these Terms and any action related thereto will be governed by the laws of the United States of America (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of California (excluding its choice of law rules).

No waiver: Either party’s failure to insist on or enforce strict performance of any of the Terms will not be construed as a waiver of any provision or right.

Severability: If any part of the Terms is held to be invalid or unenforceable by any law or regulation or final determination of a competent court or tribunal, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

No agency relationship: The parties agree that no joint venture, partnership, employment, or agency relationship exists between you and OnceLoveClub LLC as a result of the Terms or from your use of any of the Services.

Integration: These Master Terms and any applicable Additional Terms constitute the entire agreement between you and OnceLoveClub LLC relating to this subject matter and supersede any and all prior communications and/or agreements between you and OnceLoveClub LLC relating to access and use of the Services.

Privacy

OnceLoveClub LLC is committed to handling responsibly the information and data we collect about you through our Services, whether personal information or non personal browsing and site usage data. We have designed our Privacy Policy and our Data Usage Policy consistent with the following principles (the “Principles”):

1. Privacy policies and data collection and use policies should be human readable, comprehensive, and easy to locate;

2. Only the minimum amount of information reasonably necessary to provide you with services should be collected and maintained, and only for so long as reasonably needed or required;

3. Information you provide through our Services, or that we gather as a result of your use of our Services, should not be used for marketing or advertising purposes, nor should it be provided voluntarily (without your permission) to anyone else unless required; and

4. If OnceLoveClub LLC is required to provide a third party with your personal information (whether by subpoena or otherwise), then provided we have collected and retained an email address for you, OnceLoveClub LLC will use reasonable means to notify you promptly of that event, unless prohibited by law or OnceLoveClub LLC is otherwise advised not to notify you on the advice of legal counsel.

We may collect personal information through our Services, including without limitation:

• when you subscribe to one of our email discussion lists;

• when you purchase merchandise;

What we do with Personal Information

Emails and Newsletters. We use the personal information you provide to us when you send us emails or sign up to receive updates from OnceLoveClub LLC in order to respond to your request – for example, to reply to your email or to send you communications about OnceLoveClub LLC news and campaigns.

When you purchase merchandise via our Site, your personal information will be handled accordingly.

If you purchase merchandise from theOnceLoveClub LLC store (http://oncelove.club/), your personal information will be used for the purpose of sending you the items you purchased. If you sign up to receive updates from OnceLoveClub LLC when you check out from the store, we will use your personal information to send you communications about OnceLoveClub LLC news and campaigns.

Disclosures of Personal Information

In general, it is not OnceLoveClub LLC practice to disclose personal information to third parties.

However, no website can fully eliminate security risks. Third parties may circumvent our security measures to unlawfully intercept or access transmissions or private communications. Data Usage Policy: Non Personal Browsing and Site Usage Information

Non Personal Browsing Information We Collect

No Linking

We do not intentionally link browsing information or information from our server logs to the personal information you submit to us. We use this information for internal purposes only, such as to help understand how the Services are being used, to improve our Services, and for systems administration purposes. OnceLoveClub LLC may use a third party analytics provider to help us collect and analyze non personal browsing information through operation of our Services for those same purposes.

No Selling or Sharing

Except in the unique situations identified in this Privacy Policy, OnceLoveClub LLC does not sell or otherwise voluntarily provide the non personal browsing information we collect about you or your website usage to third parties.

No Retention 

OnceLoveClub LLC discards non personal browsing information from our server logs once we have used the information for the limited purposes noted above, under “No Linking.”

Children

The Services are not directed at children under the age of 13. Consistent with the federal Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personal information from anyone under the age of 13 without requiring parental consent. Our Master Terms of Use specifically prohibit anyone using our Services from submitting any personally identifiable information about persons under 13 years of age. The Services are hosted in the United States. Please note that your personal data may be located on servers in the United States. By providing your personal data you consent to the use of your personal data for the uses identified above in accordance with the Privacy Policy.

We may occasionally update this Privacy Policy. When we do, we will also revise the Effective Date below.
